There are 3 HOA’s that live in this community of 435 homes, CV1, Haven, and CV2

CV1 has 175 homes with annual dues. (Builder: Classic Homes and Keller Homes)

Haven has 70 homes with monthly dues. They have additional landscaping and snow removal services provided through vendor agreements. (Builder: Keller Homes)

CV2 has 189 homes with annual dues. (Builder: Keller Homes)

Keller Homes put this CV1 responsibility chart together while they were both building out the CV1 community and serving on the HOA board. We believe the chart was created in 2020.

The 2024 HOA board is reviewing this responsibility chart to confirm its accuracy and ensure any agreements that were made by Keller Homes are still in place or if they need updating.

Snow Removal

Snow Removal

There are 3 HOA’s that live in this community of approx. 435 homes, CV1, Haven, and CV2.  The Haven HOA is the only HOA that has paid a vendor to do snow removal.  When you drive into our Cumbre Vista community, you may indeed see Haven’s snow removal vendor outside working to remove snow from the sidewalks and driveways of their 70 homes.
 
The CV1 BOD has reached out to get quotes from snow removal vendors.   We can submit it as 2025 budget item for next year to see if the 2025 CV1 HOA budget ratification vote by the homeowners would like to increase the CV1 budget to manage snow removal.

[October 2024 Update]: The 2025 CV1 budget, which was approved by the homeowners, does not include funding for snow removal services.

Cost Estimations
3/11/24 – Monarch Commercial Landscape Services estimated the following costs for snow removal. Monarch is the same company that does snow removal for the Haven HOA.

– City sidewalks and homeowner driveways: $4,635/snow event.

– City sidewalks (in front of homeowner houses): $420/snow event.

If the HOA signed a contract for doing both the city sidewalks and homeowner driveways it would increase our HOA assessment fee by $132/year.

If the HOA signed a contract for only doing the city sidewalks it would increase our HOA assessment fee by $12/year.

The fee calculation is based on 5 events per year as per the cities stated average number of snow events requiring snow removal.

The CV1 board will be glad to implement the will of the CV1 community. An official vote by CV1 homeowners would determine the next steps.
 
Sidewalks:
In the meantime, we are all following the Colorado Springs City Code, 3.4.201: DEFINITIONS and 3.4.202: SNOW REMOVAL REQUIRED; TIME LIMITS.  In brief the city has a code established that it is the homeowners’ responsibility to shovel sidewalks within 24 hours after the termination of a snowstorm. Areas that don’t get shoveled soon after the snow is where ice forms fast. If someone slips and falls in an area you’re responsible for shoveling, you could be liable.

Driveways:
The CV1 HOA does not require homeowners to shovel their driveways. However, shoveling is highly recommended for a couple of key reasons:

1. Safety: Clearing your driveway reduces the risk of slip-and-fall accidents for you, your guests, and delivery drivers. These accidents could also pose a potential liability to your homeowners insurance policy.

2. Driveway Longevity: Regular shoveling helps extend the life of your driveway by minimizing damage caused by the freeze-thaw cycle. This cycle occurs as snow melts, partially refreezes, and expands, which can lead to cracks and misalignment of concrete sections. You may have noticed some sections of your driveway shifting—this is often a result of repeated freeze-thaw cycles.

Keeping your driveway clear not only improves safety but also helps maintain its structural integrity over time.

Common Area Sidewalk Responsibilities

WSMD confirmed the map details the snow removal responsibilities of the Metro District in Cumbre Vista. Briefly, the Metro District was hired by the city as the property manager of everything you see in red (plus other stuff) and WSMD was hired to manage the operations and maintenance of those properties. Weisburg was hired to fulfill the landscaping, maintenance, and snow removal responsibilities.

The “property owners” of everything in red on the map are those that live in Woodmen Heights Metro Districts, thus the reason we pay property taxes to “Woodmen Heights Metro District #2”. Its the second highest tax payment we make on our annual property taxes and often greater than $1000.

The responsibilities include following the City Code. In brief, after the snow ceases for 4 hours, a 24-hour timer starts to complete the snow removal from the sidewalks. There is an additional trigger that says the snow must be 3 inches or more on the sidewalk before snow removal vendors are activated. This can be a point of contention as one person’s measurement in specific area may not match Weisburg’s measurements in another area.

How you can help the community.

If you spot a snow depth of 3 inches or more on one of those red sidewalks shown in the map, and its after the 24 hour timer that started after the 4 hours of no snow trigger event, please take a picture and call WSMD at 719-447-1777 to report the issue. They asked us to report the issue in the following way.

Hello, this is <your name>. I’m a resident of Cumbre Vista in Metro District 2. It is <date and time> and there is an average snow depth of 3 or more inches on the sidewalk between “road name 1” and “road name 2” . You can reach me at <phone number>. Thank you.

Of course, if it’s the park sidewalks, just say park sidewalks or you could say the sidewalk next to Tutt Blvd etc.

As indicated above, Homeowners are responsible for shoveling the snow off the sidewalk in front of their house. As a reminder, the city code indicates that you place the snow on your property and not in the street or on your neighbors property.

The map is older, the internal sidewalk goes all the way out to Cumbre Vista Way in CV2.

3.4.201: DEFINITIONS
OWNER: Shall include the real property owner of record, whether person, partnership, corporation, firm or other association of persons, any authorized agent or representative of the owner of record, the manager of the real property, and any occupant or tenant of the real property.
 
3.4.202: SNOW REMOVAL REQUIRED; TIME LIMITS:
A.   It shall be unlawful for the owner to permit snow or ice or both to remain on the sidewalk which abuts the real property, or to which the real property is adjacent, or upon any sidewalk located upon the real property subject to a public easement or right of way, at any time after:
      1.   For residential property, twenty four (24) hours after the termination of the falling snow.
      2.   For commercial property, five o’clock (5:00) P.M. the next business day following termination of the falling snow.
